CROFT COTTAGE DEVELOPMENT, WALNEY ISLAND

Stephenson Halliday were asked by the owner to assess the planning merits of a proposed medium - sized residential development proposal, following the refusal of planning consent by the Local Planning Authority. The proposal was assessed against the provisions of the Development Plan and detailed representation made to the Planning Authority with the request to reconsider the application. However the application was again refused planning consent.

An appeal was made under Section 78 of the Town and Country Planning Act 1990 against the refusal of planning permission. The main issues were the effect of the proposal on the appearance and nature conservation interests of the adjoining Walney Channel and highway interests. A detailed planning assessment was prepared for the appeal and the Planning Authority’s reasons for refusal were thoroughly examined in relation to the Development Plan and Government policy. The outcome was successful in that the appeal was allowed and planning permission granted subject to conditions.
